Terms of service
These Terms of Service apply to your use of the ShopBuild website and any consultations, audits, quotes, digital services, ecommerce advice or implementation support provided by ShopBuild.
By using this website, booking a consultation, requesting a quote, purchasing a service or engaging ShopBuild, you agree to these Terms of Service.
About ShopBuild
ShopBuild is operated by Ecommerce Advisory Group Pty Ltd, ABN 16 689 668 371.
ShopBuild provides ecommerce consulting, Shopify audits, SEO reviews, Google Ads and Meta Ads reviews, ecommerce action plans, launch guidance, implementation support and related digital services.
Nature of our services
ShopBuild provides ecommerce advice, education, consulting, audit findings, recommendations and implementation support.
Our services may include reviewing your Shopify store, website structure, customer journey, SEO, product pages, collections, content, Google Ads, Meta Ads, Google Merchant Center, tracking, Klaviyo, apps, supplier setup, dropshipping structure, promotions or other ecommerce foundations.
ShopBuild is consultancy first. We aim to identify what is working, what is missing and what should be fixed before you spend more money on ads, apps, agencies, developers or website changes.
Free ecommerce fit check
ShopBuild may offer a free 15-minute ecommerce fit check.
The free fit check is a short qualification call designed to understand your situation and recommend the best next step. It is not a full ecommerce audit, written report, technical review, implementation session or detailed strategy session.
Paid audits and consultations
Paid audits and consultations are designed to provide practical ecommerce recommendations based on the information available at the time of review.
The exact scope of the service will depend on the service booked, the information provided, the condition of the store and any agreed focus areas.
You are responsible for providing accurate, complete and timely information so ShopBuild can properly assess your situation.
Implementation support
If you want ShopBuild to action recommendations after a consultation or audit, implementation work will be quoted separately unless it is specifically included in the service you purchased.
Implementation support may include Shopify updates, SEO improvements, product page improvements, collection updates, content changes, ads setup, Google Merchant Center support, email marketing support, tracking support or coordination with other technical providers.
No implementation work is included unless confirmed in writing or included in the agreed scope.
Quotes and scope of work
Any implementation quote or proposal will be based on the information available at the time it is prepared.
If additional issues, requirements, technical limitations, third-party platform restrictions or extra work are discovered after work begins, the scope, timeline and pricing may need to be revised.
ShopBuild is not required to complete work that is outside the agreed scope unless a new quote or written agreement is approved.
Payments
Payment terms will depend on the service selected, invoice issued or quote accepted.
Some services may require full payment before booking or delivery. Larger implementation projects may require a deposit, milestone payment or staged payment arrangement.
Unless otherwise agreed, work may not begin until the required payment has been received.
Client responsibilities
You are responsible for providing accurate information, access, screenshots, files, approvals and feedback required to deliver the service.
You are also responsible for reviewing recommendations, making business decisions, approving changes and ensuring your own legal, tax, financial, regulatory and operational obligations are met.
ShopBuild does not provide legal, tax, accounting or financial advice.
Third-party platforms
ShopBuild may provide advice or support involving third-party platforms such as Shopify, Google Ads, Meta Ads, Google Merchant Center, Klaviyo, Zoom, payment gateways, analytics platforms, apps or other tools.
We do not control third-party platforms, their policies, pricing, technical limitations, approvals, account decisions, outages or updates.
Platform approvals, ad account status, Merchant Center approvals, app performance, payment gateway decisions and third-party technical outcomes cannot be guaranteed.
Third-party providers
Where required, ShopBuild may recommend or coordinate with third-party providers such as developers, designers, agencies, contractors, technical specialists or app providers.
Unless otherwise agreed in writing, third-party providers operate separately from ShopBuild and are responsible for their own work, pricing, timelines, quality, terms and outcomes.
No guarantee of results
ShopBuild does not guarantee sales, revenue, profit, rankings, conversion rate improvements, advertising performance, platform approvals, account reinstatements, traffic increases or specific business outcomes.
Ecommerce performance depends on many factors outside our control, including product demand, pricing, competition, supplier reliability, website quality, advertising budget, customer trust, implementation quality, fulfilment, market conditions and ongoing business activity.
Intellectual property
Unless otherwise agreed, any strategies, recommendations, notes, written content, documents, templates or materials created by ShopBuild remain the intellectual property of ShopBuild until fully paid for.
Once paid for in full, you may use the agreed deliverables for your own business purposes. You may not resell, reproduce, distribute or claim ShopBuild materials as your own without written permission.
Confidentiality
ShopBuild will take reasonable steps to keep confidential business information private.
You agree not to disclose confidential information, pricing, documents, strategies, templates or private communications supplied by ShopBuild unless we have agreed in writing or disclosure is required by law.
Website information
The information on this website is general in nature and may not be suitable for your specific business circumstances.
You should not rely on website content alone as a substitute for tailored ecommerce advice, legal advice, financial advice, accounting advice or professional advice relevant to your specific situation.
Refunds and cancellations
Refunds, cancellations and rescheduling are handled in accordance with our Refund and Cancellation Policy and any rights you may have under Australian Consumer Law.
Limitation of liability
To the maximum extent permitted by law, ShopBuild is not liable for indirect loss, loss of profit, loss of revenue, loss of data, loss of opportunity, platform decisions, advertising performance, account suspensions, third-party errors or business outcomes arising from the use of our website, advice or services.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian Consumer Law.
